1. Acceptance of Terms
By scheduling service, requesting an estimate, approving a proposal, or using this website, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use our services. These Terms apply to residential and commercial work performed by Razorback Air Conditioning ("we," "us," or "our").
2. Services
We provide HVAC installation, repair, and maintenance services. The specific scope of work for each job is defined in the written estimate or work order. We reserve the right to refuse or discontinue service where unsafe, unlawful, or impractical conditions exist.
3. Estimates, Proposals & Approvals
- Estimates: Estimates are based on information available at the time and are valid for 30 days unless stated otherwise.
- Changes: Hidden conditions (e.g., code upgrades, inaccessible components, asbestos, structural issues) may require change orders that can affect price and schedule.
- Approvals: Work begins after written approval (signature, email, or electronic acceptance) and any required deposit is received.
4. Scheduling, Access & Safety
- We schedule appointments within available service windows and make reasonable efforts to arrive on time.
- You agree to provide safe access to the work area and to secure pets, valuables, and sensitive items.
- We may reschedule due to weather, emergencies, supply chain issues, or safety concerns.
5. Pricing, Deposits & Payment
- Prices exclude taxes, permit fees, and disposal fees unless expressly included.
- Deposits may be required for equipment orders or large projects and are generally non‑refundable once materials are ordered.
- Payment is due upon completion unless otherwise specified in writing. We accept common payment methods; returned payments may incur fees.
- Past‑due balances may accrue late fees and collection costs, including reasonable attorney’s fees as permitted by law.
6. Equipment, Parts & Warranty
- Manufacturer warranties apply to eligible equipment and parts; terms vary by brand and model.
- Our workmanship warranty is stated on your invoice or proposal. Improper use, lack of maintenance, or third‑party alterations may void warranties.
- We are not responsible for delays or defects caused by manufacturers or suppliers but will assist with warranty claims as a courtesy where possible.
7. Customer Responsibilities
- Maintain the system per manufacturer recommendations (e.g., filter changes, scheduled tune‑ups).
- Inform us of building rules, HOA requirements, or site constraints before work begins.
- Obtain approval from the property owner or landlord if you are not the owner.
8. Permits & Compliance
Where required, permits and inspections will be obtained in accordance with local regulations. Code upgrades mandated by authorities may result in additional charges if not included in the original scope.
9. Photos, Video & Marketing
We may document work for quality control and training. We will not publicly share identifiable images of your property for marketing without your consent.
10. Communications & Consent
By providing your contact information, you consent to receive service‑related communications (e.g., scheduling, confirmations, reminders). You may opt out of non‑essential marketing communications at any time.
11. Website Use & Third‑Party Links
Our website may contain links to third‑party sites and tools (e.g., scheduling, payments). We are not responsible for their content or practices. Use of this site is at your own risk and subject to our Privacy Policy.
12. Disclaimers
- Except as expressly stated, services are provided "as is" and "as available."
- We do not guarantee system performance where factors outside our control exist (e.g., building envelope, electrical supply, prior workmanship, manufacturer defects).
13. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services shall not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.
14. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorney’s fees) arising from your breach of these Terms or misuse of our services, except to the extent caused by our gross negligence or willful misconduct.
15. Cancellations & Returns
- Please provide reasonable notice to cancel or reschedule. Restocking or cancellation fees may apply for special‑order equipment.
- Installed parts and opened electrical/HVAC components are generally non‑returnable due to safety and regulatory reasons.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida. Any disputes shall be brought in the state or federal courts located in Palm Beach County, Florida. You agree to the exclusive jurisdiction and venue of those courts.
